TERMS AND CONDITIONS OF USE 

www.klosti.com ("the Store") is an electronic shop selling textile products, ceramics and related items, and has been established (no 658/2012) in accordance with applicable Greek law.

Before entering our online store and browse our website, we invite you to review the following terms and conditions which apply to the use of the Store. Please make sure you agree with the following terms and conditions, as any further use and navigation through the website klosti.com implies your explicit and unconditional consent and agreement with them. We advise you to regularly consult this section, to be notified of any changes that may have been attached to the original text and, therefore, have become mandatory for all users.

1. User Obligations

The user / customer explicitly recognizes his/her obligation to provide, when requested, only truthful, accurate and valid data, so as not to negatively affect the function of the Store (for example, forwarding of sold items). The user of the site www.klosti.com is bound to comply with the current legislation regarding behavior on the Internet, in particular provisions regarding transmission of electronic data.

2. Intellectual Property

 
The Store informs the user that the entire content of information and services provided on the website, is intellectual property of the Store and is protected by applicable copyright laws. The content of this website is solely provided for the information of visitors / users and for making sales. Therefore, no material published on the website may be sold, copied, reproduced / republished or broadcasted in any way without prior written consent of the Store. As an exception, isolated electronic storage of part of the content is possible, for personal - not commercial – use, without deletion of data identifying the particular material with the Store (eg. watermark) and always in compliance with copyright laws.

3. Limitation of Liability

 
The website of the Store may at times contain information, text, or other material provided by third parties, as well as links to other websites, for advertising or other purposes. The Store chooses to host such content for purposes that it considers beneficial for its development, but it is not able to guarantee the accuracy, completeness, reliability and availability of such content provided by third parties. Any reference to a product or service of a third party on the website of the Store, does not imply corresponding support by the Store, does not constitute any offer for sale and / or purchase / supply of such products, and the Store declines all responsibility concerning the reliability and availability of such product or service. Therefore, if a visitor / user chooses to reveal personal data, communicate or make any agreement with third party material or links hosted on the website of the Store, as well as with products or services offered by the hosted third party, does so entirely at their own risk. For any issue related to third party content, the visitor / user shall refer to the terms and conditions of use of the website related to the particular content, or to directly communicate with those responsible for their operation.

The Store aims to provide its services continuously and without interruption. This, however, does not mean that it renounces the right to pause part or all of its services, temporarily, for extended periods, or permanently, with or without prior notice to users. Also, the Store may at any time terminate all or part of the services offered to users, if the Store considers that the particular users have acted maliciously, having violated the terms of use, or the spirit of these terms.

4. Security

The Store pledges to the user that it provides valid information and services solely aiming at the satisfaction of the user / customer. Although the Store has taken all necessary measures to ensure its smooth operation, it cannot exclude any malicious viruses, users / hackers who (would) aim to damage the Store or its users. Therefore, it disclaims any liability related to any loss or damage caused to any user, by information appearing on the site as a result of malicious actions. The Store also disclaims any liability for any damage caused to the user by any difficulty of access to the site. To accomplish a sale, the Store will ask the user to provide personal data such as name, shipping address, telephone number, as well as email address. In cases of corporate customers, the Store will additionally request their Taxpayer Identification Number (TIN) and the corresponding Tax Office, in order to issue the necessary tax documents.

The Store can utilize and process all or part of data collected from its customers, to analyze their preferences, send newsletters and make offers to customers, unless the user requests in writing - by sending an e-mail to sales@klosti.com - to not receive such newsletters and / or offers. In any case, the data collected on user preferences are not disclosed to third parties, with the exceptions set out in this agreement (see following paragraph). Finally, the user may modify his/her personal data or even delete them, by sending an e-mail to sales@klosti.com

5. Protection of Personal Data / Privacy

The Store pledges to users / clients that it follows all legal provisions relating to the protection of personal data, and that it will not provide customer information to any third party without the written consent of the users, with the exception of cases where such data are requested for the creation of tailored products (specifically for the client), or are requested by the authorities. Finally, the Store informs the users that it can forward to its suppliers general statistical data, which, however, in no way identify individual buyers, as such data (would) only outline market trends.

As regards the protection of users’ personal data, the Store informs the users that all personal data is encrypted through the SSL (Secure Sockets Layer) protocol, which is a protocol concerning the communication between internet users and web servers.

6. Cookies

In an effort to provide quality services to users / customers, the Store uses cookies. These are coded bits of information, which are stored in the user's device when he/she visits the website, and "recognize" him/her in subsequent visits. The main service provided by the Store, i.e., the sale of products, becomes possible only if the user accepts the use of cookies, as identification of the user is required during the various stages up to the completion of the sale (e.g. user settings, order status etc.). Further reasons for which the Store may use cookies include: collection of statistical data to help improve the content and the website in general, commercial considerations related to the time spent by the visitors / users on the website, as well as assessment of the impact of advertising, advertising reasons relating to options for banners corresponding to visitors’ / users’ preferences, and, finally, issues associated with the Store development through social networks. The user reserves the right to modify the settings of the device used for internet navigation so that his/her consent is required before the site makes use of cookies. However, non-acceptance of cookies means that the user will not be able to benefit from all the services / features offered by the Store.

7. Purchase of products/Payment options

The Store selects and presents quality products, always aiming at customer satisfaction, provides all the basic relevant information (images, features, price including VAT, availability, etc.) and meets all the labeling requirements for products such as magnets, soaps etc. in accordance with the law. However, the user / customer must understand that the products of the Store are NOT toys and are NOT meant for sale to minors. Also, the Store disclaims any liability resulting from misuse of its products, or failure to comply with the instructions for use, or use of the products in a way that violates common sense. Finally, the Store declares that its products are meant for sale to adults only, and bears no responsibility if purchases are made ​​by minors.

The ordering process is simple and does not require user registration as a member of the website. The user selects the desired product / products, quantity and color (if the product is available in more than one color). The selected items are "placed" in the shopping cart, and the user is able to configure them as he/she wishes without limitation, within the parameters set by the Store.

The users have the option to pay by deposit in a bank account disclosed to them if they choose this method. After depositing the sum, the user is requested to inform the Store electronically - at sales@klosti.com - about the deposit, and, if possible, provide proof of deposit. Users can also pay for their order using their credit, debit or prepaid card. In such a case, the Store informs the users / customers that, for the protection of their credit card data, the Store is linked directly to the website of Alpha Bank where the transaction is made, and therefore has no access to the card data. After the transaction is completed, the user is automatically transferred to the website of the Store, which is informed about the success (or not) of the transaction, and does NOT receive any information from the Bank regarding the user’s/customer’s data at any stage of the transaction.

Finally, in case of delivery of products within Greece, the customer has the option of payment on delivery, i.e. to make a cash payment for the order to the courier, upon delivery. In such a case, the user / client is obliged to (i) pay in full for the order and (ii) comply with the agreement regarding delivery by courier. Otherwise the Store would consider the user / client as undesirable and reserves the right not to (re)send the ordered products. The only exception is, if timely information / explanation of the inability to comply has been provided by the customer, via email at sales@klosti.com, which, however does not bind the Store to resend the products.

8. Shipment of products

For proper shipment of the products ordered by the user / client, it is necessary that he / she provides the Store with all the necessary information. The information must be true and accurate, otherwise the Store is not responsible for the delivery of the products (or its delay). As regards the shipment, the Store has signed cooperation contracts with prestigious courier companies, providing competitive prices for its customers. The pricelist of shipments is periodically adjusted to maximize the benefit of the users / customers of the Store. In summary, it should be mentioned that as regards pricing, Greece is divided in three zones: Attica, rest of the country (excluding difficult-to-access areas), and difficult-to-access areas. For orders within the European Union, products are sent by the Store by registered mail. For more information about shipment details, the user can refer to section "Delivery Methods". The Store does not offer other options for shipment of products, other than its cooperation with a courier company, and the user must agree and accept this limitation so that his/her order is properly processed.

9. Order Cancellation/Withdrawal

The Store provides the user the option to cancel an order. To do so, the user must send an email to sales@klosti.com. Any sum paid towards the order is returned to the user, reduced only by possible bank fees. No order cancellation is accepted after shipment has been made.

The user / customer has the right of withdrawal, for all products of the Store, with the exception of those manufactured on request especially for the customer. The right of withdrawal may be exercised by the customer within 14 days of receipt of the goods by him/her or his/her representative provided that he/she (i) sends an email to sales@klosti.com informing the Store about the product to be returned or (ii) completes the withdrawal form attached here (..) and in the "Returns" section of the website. So that no value of the returned product is lost, we recommend the customer to pack it very carefully.

As regards shipment (return) of the product, the Store will propose that the customer residing in Greece uses the courier company cooperating with the Store, due to its competitive pricing, so that the particular courier company collects the product for shipment. Nonetheless, the final selection is made ​​by the customer, as he/she is responsible for the shipment cost for the product that is to be returned. The customer must return the product within 14 days from the date of declaring the withdrawal, and inform the Store about the chosen method of shipment.

After receiving the product or other proof of dispatch, and verify that the product is intact, the Store will reimburse the customer for the equivalent of the product price plus the shipping costs, by deposit to a bank account number provided by the customer, or by the method used by the customer when he/she made the payment, according to the customer’s choice. Otherwise, i.e., if the product is not received in good condition, especially if found used beyond the extent necessary to establish its nature / character, for example if tags have been removed, or damage or cracks are evident, the value credited to the customer will be reduced and will vary between 30-50% of the original, on a case by case basis. If the customer has chosen the courier company cooperating with the Store, then the cost of returning the products will be offset by the cost of delivery, which consequently will not be returned to the customer.

10. Defective Products

 
The store ensures that all orders are checked before dispatch. However, if the product received by the customer is defective, this will be replaced, or the customer will be credited for the equivalent value. A prerequisite is the timely (within three days of receipt) written notification to the Shop by email to sales@klosti.com, including attached photograph of the product showing the defect. If no photo is sent, or in order to upgrade its services, the Store could request that the product is sent to it by the customer, with the Store being responsible for the cost of shipment.

In addition to the replacement of defective products, the Store is interested to hear about any negative experience or customer complaint, and for this purpose the customer should in any such case contact the Store immediately at sales@klosti.com.

11. Amendment of Terms/Jurisdiction

 
The store has the right to modify these terms without specific notice to users of the website. For this reason, users are requested to take note of the terms and conditions prior to use of the website, as they are binding on them.

It should also be noted that in case the Store neglects to exercise any right or power or claim of compensation to which it is entitled by law or arising from the terms of use as defined in this section, this does not mean that such rights have been waived. These terms and conditions are governed by and construed in accordance with the current Greek legal framework and are fully harmonized with the European legislation on electronic data and privacy. Any dispute arising from or in connection with these terms and conditions, will be handled solely by competent courts of Athens.
